This Privacy Policy describes our privacy practices associated with the website Libsyn.com, software products and online Services (“Services”) of Liberated Syndication (“Libsyn”) by visitors to our website, our customers that use our Services, advertisers and end users of our customer’s podcasts.
Personal Information means any information relating to, directly or indirectly, an identified or identifiable natural person (a “data subject”).
This Privacy Policy applies to:

Our customers who access and use our software products and online Services, including podcast hosting, distribution and monetization Services
Our customers’ end users, who access our customers’ podcasts and other content (i.e., listeners of podcasts hosted by Libsyn)
Advertisers (including agencies) which purchase our advertising products or Services to serve ads on our customers’ podcasts and other content
Visitors to our website or other online properties

Status of Libsyn

Libsyn as a Processor. Libsyn acts a processor (or a service provider under California’s privacy law) when it is providing its Services to its customers, such as when using our hosting or distribution Services for your podcast or other content. Our customer is acting as a controller (or covered business under California’s privacy law). However, we act as a controller for customers’ account billing data.

Libsyn as a Controller. We are acting as a controller (or covered business) when you access a customer’s podcast or other content that we host or distribute. We are also a controller when you visit our website or contact us through the website or otherwise.

In addition, we are a controller (or covered business) when providing our independent advertising and monetization Services.

Personal and Corporate Information

Libsyn provides rich media broadcast promotion and advertising ServicesServices and distributes media and software products for Servicesindividuals, small businesses, major enterprise customers and ISPs. Libsyn understands its customers’ need to protect Personal Information, billing information, account information and end user information. Use of Libsyn Services requires that Libsyn gather, track and use Personal Information for effective operation and support. It is the nature of our software to gather and study specific information about customers, end users, computer systems, network usage and IP addresses, user profiles and e-mail addresses, and the use of media programs in order to generate and study usage patterns, usage history, compliance with account policies respecting e-mail or software usage, advertising and promotional usage, and so forth.

Libsyn reserves all rights in the statistical and aggregate data that it generates from Libsyn Services, and the right to use that information to provide data ServicesServices and support Libsyn Services to its customers.

What Information We Collect

We request and use personal and corporate information when you create an account, authorize your users, request or operate Libsyn Services, create and publish data reports, provide advocacy support with ISPs or corporate sites regarding your broadcast usage, or correspond with us. For example, if you request technical support online or via telephone, we will ask you for information necessary to authenticate you as a customer or end user, and to provide the requested support, such as your name, address and information about your computer hardware, software and the nature of the problem you are experiencing.

Collected Automatically. When you visit our website, we may collect non-indirect information about you—such as an IP address, device type, device ID, Internet service provider, general location information, page views, a date/time stamp, browser type, referring/exit URLs, search terms used on our Site, operating system, and similar device and usage information.

Listeners of Hosted Podcasts. When you listen to an episode created by one of our podcast clients, our servers automatically record certain technical interactions required to deliver the audio file, ensure network security, and measure episode performance: your IP address, timestamp, information about the requested audio file and the portion of the file streamed or downloaded, and your device’s User-Agent string, which details the app, operating system, or media player used to access the show. In some instances, we may also receive a referring URL if you accessed the episode link from an external website or application.

Account Information. In most cases, customers will be asked to provide personal and corporate account information specific to each Libsyn Product & Service. This information will, in most cases, be required for Libsyn to provide the service in a secure environment to you. This may include your name, address, business information, e-mail, US Mail, telephone, facsimile, IP address(es), network domain(s), subscription, credit card or other billing information, and other information necessary to provide effective Services, maintenance and support to your account and your end users. In general, Libsyn will store and use such personal and corporate account information to provide you with Libsyn Services.

Payment Information. Some our Services require payment. We use Stripe to process your credit card transactions. Stripe’s privacy policy (https://stripe.com/privacy) will apply to the information you provide on the Stripe site. You must be 18 or older to authorize a purchase through our Services.

Cookies and other Tracking Technologies. As further described below, we also collect information through cookies and other tracking technologies. Customer Support. Libsyn may record support calls, create tracking tickets, log files, or other records of your support or user requests, for purposes of supporting you as a customer and/or providing Libsyn Services to you. In representing you or Libsyn on public resources, such as discussion groups, technical searches, Libsyn will maintain anonymity for its customers.

Other Collection. Some Libsyn Services may create data files containing your personal and customer information; that information is subject to your control and dissemination is dependent upon your own security and privacy practices. We advise you to inform your end users of such policies and practices.

Libsyn also maintains active license records embedded within Libsyn Services. Libsyn will perform compliance audits on its network systems using your personal and corporate information, system usage, billing and account information, in order to maintain a registered subscriber base and to maintain usage records, and to prepare customer invoices and license renewals.

We may also maintain such recordings, logs or other records to track usage of the Libsyn Services by end users and to track the status of maintenance and support dialogues with end users and customers, to improve our Services to customers.

Providing requested personal and corporate information is completely voluntary. While individuals are under no obligation to provide such information to Libsyn, our customers may not get the full benefit of our products, Services and support without providing such information. In some cases, you may not be able to access user accounts online or operate Libsyn Services if you withhold such information.

How We Use Your Collected Information

In many cases, you may decide whether to authorize any operation that requests Personal Information. If you do not wish to provide the requested information, however, you may not be able to use the pertinent Libsyn Services. This includes operating Services online, as well as Libsyn support and maintenance.

Libsyn will use personal and corporate information as follows:

  1. To provide you with the requested Services, including access to our customers’ hosted podcasts.
  2. To provide you with informative newsletters, e-mails, and future product ideas or improvements;
  3. To provide you with end user support and account maintenance information;
  4. To assist Libsyn in creating better products and Services for its customers;
  5. To provide information to and advocate for Libsyn customers with ISPs and corporate network administrators;
  6. To provide information about aggregate usage and trends on topics relating to account management; and,
  7. To provide you with access to information or otherwise engage in activities, such as product testing or evaluation for Libsyn Services.
  8. To send you marketing or promotional messages or offers via the email address associated with your account.

With Whom We May Share Your Information

From time to time, unless we have stated otherwise, we may provide certain information to ISPs and corporate network administrators in order to effectively provide Libsyn Services to you. For example, in providing support Services for our customers, Libsyn may need to share information about your Services, privacy policy and account information with support personnel at ISPs and service providers.

In addition, Libsyn may from time to time retain the Services of outside contractors or third parties to provide and/or host online Services for its customers. Such parties may provide online maintenance and technical support or perform other Services for Libsyn customers. We require that these contractors keep the Personal Information of customers secure and confidential. We also require that these parties use your personal and account information only your behalf and/or to provide direct support for Libsyn Services.

We may share your information in connection with a corporate merger, consolidation, restructuring, sale of certain of our ownership interests, assets, or both, or other corporate change, including without limitation, during the course of any due diligence process.

In addition, we may share your information when we are required to do so by law, such as to comply with a subpoena, bankruptcy proceedings, or similar legal process, or in response to lawful requests by public authorities.

If we would like to use your Personal Information for any purposes other than those described in this Privacy Policy, or as otherwise permitted under applicable law, we will obtain your prior consent.

Cookies and Other Tracking Technologies

A cookie is a small piece of data that your internet browser places on your device so that it can be recognized when it returns in the future. We use cookies and similar technologies to secure our website, remember your preferences, and personalize content for your future visits.

The length of time that a cookie remains on your device depends on whether it is a “persistent” or “session” cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies on our website are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device. Cookies set by us as the website owner are called “first-party cookies.” Cookies set by parties other than the website owner are called “third-party cookies.” Third-party cookies enable third-party features or functionality to be provided on or through the website (e.g., advertising, interactive content, and analytics). The parties that set these third-party cookies can recognize your computer both when it visits the website in question and also when it visits certain other websites

We deploy the following types of cookies on the website and Services:

Strictly Necessary Cookies. These cookies are essential for our website to function properly and cannot be switched off in our systems. These cookies do not store any Personal Information.

  • Performance/Analytics Cookies. hese cookies allow us to count visits and identify web traffic sources so we can measure and improve the performance of our website. They help us to know which pages are the most and least popular and see how visitors navigate the website. All information these cookies collect is aggregated and therefore anonymous. hese cookies may be set by third parties, such as Google Analytics.
  • Functional Cookies. These cookies enable our website to provide enhanced functionality and personalization. They may be set by us or by third-party providers whose Services we have added to our webpages. If you do not allow these cookies, these Services may not function properly.
  • Advertising/Targeting Cookies. These cookies may be set through our site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites. They do not store Personal Information that identifies you directly but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising. Under certain US state privacy laws, the deployment of these cookies may be considered a “sale” or “sharing” of Personal Information for targeted advertising. We deploy third-party advertising/targeting cookies from Google Advertising (NID) and Google DoubleClick (IDE).

Libsyn may also use cookies to track your visit to our Websites. While our Web servers may automatically log your IP address, such basic Internet traffic statistics will not be tied back to other Personal Information.

You can manage cookies through your browser or device settings. However, if you disable certain cookies, some features of the websitemay not function properly. For more information about cookies and your choices, see allaboutcookies.org. You also may refer to the “Your Privacy Rights and Choices” section below and any cookie-specific notices we may provide. Where required by law, we will obtain your consent before placing non-essential cookies.

In addition, we may use web beacons, pixel tags, and similar technologies on the Restaurant Branded Apps and Website and in emails to determine whether a page has been viewed or an email has been opened. These tools help us understand which pages and features are most popular, which emails are effective, and how to make the Services and our communications more user-friendly.

Google Analytics

We use Google Analytics to help us manage and improve our websites and Services. For more information on how Google Analytics collects and processes data, see www.google.com/policies/privacy/partners/. Google Analytics uses “cookies” to help us analyze how users use and view the website. Any information generated by the cookie about your use of our website (including your IP address, and particulars about your browser and configuration as reported by your browser) may be transmitted to and stored by Google on servers in the United States. Please note any information collected by Google Analytics cookies do not include Personal Information (such as names, e-mail addresses, and payment information). Google may use the information collected for the purpose of enabling us to evaluate your use of our website, certain aspects of your user experience thereon, compiling reports on activity for us and providing other services relating to our website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. Advertising/Remarketing

Libsyn may use your Personal Information to provide you with targeted advertisements or marketing communications that we believe may be of interest to you. We deploy third-party advertising/targeting cookies from Google Advertising (NID) and Google DoubleClick (IDE).

You can opt of targeted advertising by visiting the Digital Advertising Alliances opt-out portal at http://optout.aboutads.info/. You can also opt out targeted advertising from Facebook and Google at:

ID5. In addition, we use third-party technologies from ID5 (website at: ID5.io) that operate concurrently when you visit our website to intercept, monitor, and record your interactions with our website and the webpages visited, including the collection of device identifiers and IP addresses for the purposes of identity resolution and security. Collected signals include IP addresses, timestamps, user agent, hashed identifiers and other signals that are collected by ID5 directly from your browser. ID5 does not collect or process name, raw email address, financial information, behavioral data, page content-related information, or any directly identifiable Personal Information. ID5 permanently deletes all collected signals within 100 days of their collection and/or receipt.

For these purposes, ID5 acts as an independent Controller (or a “third party” or “business” under California’s privacy law). The transmission of Personal Information to ID5 may constitute a “sale” (transfer for value) and/or “sharing” (transfer for cross-context behavioral advertising) under applicable US state privacy laws to enable ID5 to process this Personal Information as a third party or business.

Policy Changes

In the event there is a major change to our privacy practices, Libsyn will in most cases provide advance notice to its users via postings on the Libsyn website and/or user portal, or via e-mail.

If the change involves the use of your Personal Information, the notice will contain instructions on how you can opt-out of such use, or modify your Personal Information to suit the intended use.

If the change involves changes to your assigned user account information, personal and corporate information, billing information, and/or related web and e-mail addresses, the notice will direct you to an administrative console to review and/or edit the information associated with your user account or provide you with contact information so that you can make the requested changes in a secure manner.

Response to Legal Disclosures

Please be advised that in certain instances, it may be necessary for Libsyn to disclose personal and corporate information about its customers at the request of government officials or agencies, by subpoena or legal proceeding, or otherwise as required by contract or other legal obligations. This could include a court proceeding, foreign or domestic, that requires us to disclose such information. Libsyn may make such disclosures without prior notice to its customers, and without seeking prior advice and counsel of its customers.

Security and Quality of Personal Information

We maintain security measures to protect your Personal Information, including technical and procedural steps to protect your data from publication, misuse, unauthorized access or dissemination, loss, alteration or destruction. These measures include encryption of data in transit, access controls, and regular security assessments.

BE ADVISED THAT NO DATA TRANSMISSION OVER THE INTERNET OR ANY WIRELESS NETWORK CAN BE GUARANTEED TO BE 100% SECURE. WHILE WE STRIVE TO PROTECT YOUR PERSONAL INFORMATION USING COMMERCIALLY AVAILABLE AND INDUSTRY-STANDARD SECURITY MEASURES, WE CANNOT ENSURE OR GUARANTEE THE SECURITY OF ANY INFORMATION YOU TRANSMIT TO US, AND YOU DO SO AT YOUR OWN RISK.

If we determine that your Personal Information has been or may reasonably have been compromised due to a security breach of our systems, we will notify you in accordance with and to the extent required by applicable law using the contact information we have on file.
How Long We Keep Your Personal Information

In general, we will only retain your information for the time necessary to realize our legitimate business purposes and to comply with the law. We may retain your information in order to prevent, investigate, or identify possible wrongdoing in connection with our Services or to comply with legal obligations. We may also maintain residual copies of your Personal Information in our backup systems.

We may retain account information, media files and metadata for a period of six months after service cancellation due to the nature of the automated process for suspending and closing accounts for nonpayment. When closing an account, users may delete all media files and metadata from the system before closing the account to ensure no data is actively retained.

Personal and credit card information is removed from our third-party merchant Braintree and no longer retained after service with Libsyn is cancelled.

Children’s Information

Our website and Services are designed for adults aged 18 and over. We do not knowingly process personal data of any under 16, and should we become aware that any personal data is stored regarding a child under 16, we will follow our internal processes to delete this data in accordance with your data protection rights as soon as is reasonably possible.

Hyperlinks

This Privacy Policy only applies to information collected when visiting our website or otherwise using our Services. While visiting our website or using the Services, you may be directed through links to third-party websites or Services that are not operated or controlled by us. We are not responsible for the privacy practices and policies of these third parties. As a result, we encourage you to review the privacy policies of these third-party websites as their practices may differ from ours.

Located in the United States

We are located in the United States. Information that we collect will be stored and processed in the United States in accordance with this Privacy Policy. We may transfer and access Personal Information from around the world, including but not limited to the United States. This Privacy Policy shall apply even if we transfer Personal information to other countries. By accessing the website or our Services, you consent to this transfer, processing, and storage of your Personal information in the United States or other jurisdictions, including to jurisdictions in which the privacy laws may not be as comprehensive as those in the country where you reside. Note that your Personal Information may be available to the United States government or its agencies under legal process in the United States.

US State Privacy Notices

Certain US state privacy laws, including the California Consumer Privacy Act (as amended by the California Privacy Rights Act) (collectively, the “CCPA”), as well as similar consumer privacy laws in other US states, provide residents of those states with specific rights regarding their PersonalOinformation. This section describes those rights and how to exercise them, to the extent these laws apply.

Categories of Personal Information We Collect. In the preceding 12 months, we may have collected the following categories of personal information (as defined by the CCPA and similar laws) in connection with the Services:

  • Identifiers (e.g., name, email address, postal address, phone number, IP address, device identifiers);
  • Customer records and account information (e.g., account credentials, billing information);
  • Commercial information (e.g., order history, payments, transaction information);
  • Internet or other electronic network activity information (e.g., browsing history, usage data);
  • Geolocation data (e.g., IP-based location, precise location where enabled);
  • Audio, electronic, visual, or similar information (e.g., customer support call recordings, user-generated content);
  • Inferences drawn from other Personal Information (e.g., preferences and characteristics); and
  • Professional or employment-related information (e.g., business contact details, role).

Purposes for Collection and Disclosure. We collect and disclose the categories of Personal Information listed above for the business and commercial purposes described in the “How We Use Your Collected Information” and “With Whom We May Share Your Information” sections of this Privacy Policy.

Disclosures for Business Purposes. In the preceding 12 months, we may have disclosed the categories of Personal Information listed above for “business purposes” (as such term is defined under the CCPA and similar laws) to the following categories of recipients:

  • Our service providers;
  • Advertising partners (e.g., ID5)
  • Affiliated entities and corporate transaction counterparties;
  • Governmental authorities and third parties in connection with legal, compliance, and safety purposes; and
  • Other third parties with your consent or at your direction.

Sales and Sharing of Personal Information. As described above, the use and transmission of Personal Information (including to ID5) to serve you advertising may constitute the “sale” and/or “sharing” of Personal Information for cross-contextual behavioral advertising under applicable US state privacy laws. You can opt out of this sale/sharing by submitting this request via email to: privacycompliance@libsyn.com. (Include the subject line “California Resident – Do Not Sell or Share My Personal Information.)

If you have implemented a browser-based opt out preference signals, such as Global Privacy Control (see: https://globalprivacycontrol.org/), we will recognize such preference in accordance with applicable law.

Other California Notices.

Pursuant to California’s “Shine The Light law (California Statute § 1798.983), California residents are entitled to request, once a year and free of charge, certain information regarding what types of their Personal Information may be shared with third parties and, in some cases, affiliates, for those third parties’ and affiliates’ own direct marketing purposes. Under the law, a business is to either provide California customers certain information upon request or permit California customers to opt out of this type of sharing. For California residents under the age of 18 and registered users California law (Business and Professionals Code § 22581) provides that you can request the removal of content or information you posted on our website. Any such request should be sent to us at: [email along with a description of the posted content or other information to be removed. Be advised, however, that applicable law may not permit us to completely or comprehensively remove your deleted content or for other reasons as set forth in this California law.

The California Online Privacy Protection Act (CalOPPA) requires that online privacy notices disclose how a site responds to “Do Not Track” signals (DNT). We currently do not honor DNT signals.

Your Privacy Rights and Choices

Your Privacy Rights. Subject to applicable law, residents of certain US states (including California) may have the following rights regarding their Personal Information:

  • Right to Know/Access. The right to request that we disclose the Personal Information we have collected about you, including specific pieces of information and additional details about our data practices.
  • Right to Delete. The right to request that we delete Personal Information that we have collected from you, subject to certain exceptions.
  • Right to Correct. The right to request that we correct inaccurate Personal Information that we maintain about you.
  • Right of Portability. Where technically feasible and required by law, you may request a copy of your Personal information in a structured, commonly used, machine-readable format.
  • Right to Opt Out of Sales or Sharing. The right to direct us not to sell or share your Personal Information, as those terms are defined in the CCPA or other US state consumer privacy law.
  • Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.
  • Right to Know Categories of Personal Information, etc. You have the right to know the categories of sources from which the Personal Information is collected; the categories that were sold or disclosed for a business purposes, and the categories of third parties to whom Personal Information was sold or disclosed for a business purpose.

To submit a request, contact us at: privacycompliance@libsyn.com. We may ask to verify your identity and state of residence before processing your request. You may also designate an authorized agent to make a request on your behalf. We will confirm receipt of your request within 10 business days. We must provide the requested information or delete your Personal Information within 45 days of receipt of your request, but we can use up to an additional 45 days if we let you know that additional time is needed.

Preferences and Account Information. If you would like to change your user preferences and account information, you may contact Libsyn and/or access the administrative pages for your account on the applicable Libsyn Website. Methods for doing so appear at the end of this policy statement.
Status information on account, account usage, billing, billing practices, user profiles and changes thereto, system status, and so on, may also be sent by Libsyn using your personal and corporate information.

You can opt out of receiving such communications by changing your communication preferences in the administrative console associated with your access and use of our Services. 

Libsyn may request that you verify personal or corporate, account or billing information from time to time as you use Libsyn Services.

Modifications to your personal and corporate information, and restricting its use by Libsyn Product & Services may, however, curtail the level of service or communications thereon provided to you by Libsyn.

Marketing/Promotional Messages. If you do not wish to continue receiving promotional communications from Libsyn, such as e-mail or online newsletters, you can opt-out of receiving these communications by replying to the unsubscribe in the subject line in the email or changing your communication preferences on the administrative pages for your account.

Cookies and Online Tracking. As described above, you may be able to set your browser to refuse cookies or to alert you when cookies are being sent. You may also use industry tools and device settings to limit certain advertising or analytics cookies and similar technologies. Please refer to your browser or device documentation for more information. Also see allaboutcookies.org for further information. 

European Economic Area, United Kingdom, Switzerland

If you are an individual in the European Economic Area (EEA), United Kingdom or Switzerland, we collect and process Personal Information about you only where we have legal basis for doing so under applicable data protection laws in these countries (the General Data Protection Regulation in the EEA; the UK GDPR in the United Kingdom and the Federal Act on Data Protection in Switzerland), including as follows: 

  • We need your Personal information to provide you access to and use of our website or Services, including to operate them, provide customer support and personalized features and to protect the safety and security of the website or Services;
  • For our legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our products and Services and or to protect our legal rights and interests;
  • You give us consent to do so for a specific purpose; or
  • We need to process your Personal Information to comply with a legal obligation.

We are the controller of information that you provide in order for us to provide the website and Services for your use. You are the controller of any information that is entered during and as part of your use of the Website, Apps and Services, and we are the processor of that information on your behalf. We will process the information according to your instructions, which you give us in the process of accessing and using the website or Services.

You have the right to exercise certain specific choices with respect to your Personal Information:

  • Ask how we use your Personal Information, to access your Personal Information and receive copies of your Personal Information we have collected.
  • Withdraw any prior express consent that you have provided to the processing of your Personal Information at any time without penalty.
  • Access your Personal Information and have it corrected or amended if it is inaccurate or incomplete.
  • Obtain a transferable copy of some of your Personal Information that can be transferred to another provider when the Personal Information was processed based on your consent.
  • If you believe your Personal Information we retain is inaccurate, no longer necessary for our business purposes, or if you object to our processing of your Personal Information, you also have the right to request that we restrict the processing of your information pending our investigation and/or verification of your claim.
  • Request that your Personal Information be deleted or restricted under certain circumstances. For example, if we are processing your personally identifiable information on the basis of your consent and has no other legal basis to use such, you may request your Personal Information be deleted when you withdraw your consent.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

If you are not satisfied with our response, or believe we are processing your Personal Information in violation of the law If you have concerns, you can submit a complaint with your relevant supervisory authority:

We will strive to respond within one month or will advise you if additional time (up to another two months) is needed.

We endeavor to apply suitable safeguards to protect the privacy and security of your Personal information and to use it only consistent with your relationship with us and the practices described in this Privacy Policy. We also take steps to minimize the risk to your rights and freedoms by not collecting or storing sensitive or special categories of Personal Information about you.
